# Lumeail Terms of Service

These Terms of Service govern your use of **Lumeail**, an email design, sending, automation, and domain management platform operated by **Dgiart Studio** (Udyam Registration: UDYAM-UP-75-0132782) at https://lumeail.com.

## 1. Introduction
Welcome to **Lumeail**. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who wish to access or use the Service.

*   You are responsible for safeguarding your account credentials. Do not share your password.
*   You are responsible for all activity that occurs under your account.
*   Notify us immediately at support@dgiart.com if you suspect unauthorized access.

## 4. Acceptable Use
You agree NOT to use the Service to:
*   Send unsolicited bulk email (spam) or violate anti-spam laws (CAN-SPAM, GDPR, etc.).
*   Transmit malware, phishing content, or deceptive materials.
*   Harass, abuse, or harm any individual or group.
*   Infringe on any intellectual property rights.
*   Attempt to reverse-engineer, decompile, or hack the Service.
*   Violate any applicable local, national, or international law or regulation.

Violation of this policy may result in immediate suspension or termination of your account.

## 5. Intellectual Property
*   **Your Content**: You retain full ownership of all Content you create using the Service. Lumeail claims no intellectual property rights over your Content.
*   **Our Platform**: The Service itself — including its design, code, branding, logos, and UI — is owned by Dgiart Studio and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform.
*   **License to Us**: By uploading Content, you grant Lumeail a limited, non-exclusive license to host, store, and display your Content solely for the purpose of operating the Service.

## 6. Subscriptions & Payments
*   Some features require a paid subscription. You will be clearly informed of pricing before any purchase.
*   Payments are processed by **Stripe**. We do not store your payment card details.
*   Subscriptions renew automatically unless you cancel before the renewal date.
*   Refunds are handled on a case-by-case basis. Contact support@dgiart.com for refund requests.
*   We reserve the right to change pricing with at least 30 days' notice before the change takes effect.

## 7. Email Sending & Domain Usage
*   You are solely responsible for the content of emails you send through the Service.
*   You must comply with all applicable email marketing laws (CAN-SPAM, GDPR, PECR, etc.).
*   Lumeail may suspend your sending privileges if we detect abuse, high bounce rates, or spam complaints.
*   Custom domains connected to your account must be domains you own or are authorized to use.

## 8. Service Availability & Modifications
*   We strive for high availability but do not guarantee uninterrupted access.
*   We may modify, update, or discontinue features of the Service at any time.
*   For significant changes, we will provide advance notice via email or in-app notification.
*   We are not liable for any loss resulting from scheduled or emergency downtime.

## 9. Limitation of Liability
*   The Service is provided "as is" and "as available" without warranties of any kind.
*   Lumeail and Dgiart Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
*   Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.
*   We are not responsible for losses caused by third-party services, internet failures, or events beyond our reasonable control.

## 10. Indemnification
You agree to indemnify and hold harmless Dgiart Studio, its employees, and affiliates from any claims, damages, or expenses arising from:
*   Your use of the Service.
*   Your violation of these Terms.
*   Your violation of any third-party rights.
*   Content you create, upload, or send through the Service.

## 11. Termination
*   You may close your account at any time by contacting support@dgiart.com.
*   We may suspend or terminate your account immediately, without prior notice, if you breach these Terms.
*   Upon termination, your right to use the Service will cease immediately.

*   Data deletion requests after account closure will be processed within 30 days.

*   Any disputes will first be addressed through good-faith negotiation.
*   If a dispute cannot be resolved, it shall be submitted to binding arbitration or the competent courts in the jurisdiction of the user's residence, subject to applicable consumer protection laws.
